STRUCTURED ANNUITY SETTLEMENT NEW 2015

STRUCTURED ANNUITY SETTLEMENT NEW 2015

A structured settlement is a financial or insurance arrangement whereby a claimant agrees to resolve a personal injury tort claim by receiving periodic payments on an agreed schedule rather than as a lump sum. Structured settlements were first utilized in Canada after a settlement for children affected by Thalidomide.[1] Structured settlements are widely used in product liability or injury cases (such as the birth defects from Thalidomide). A structured settlement can be implemented to reduce legal and other costs by avoiding trial.[2] Structured settlement cases became more popular in the United States during the 1970s as an alternative to lump sum settlements.[3] The increased popularity was due to several rulings by the IRS, an increase in personal injury awards, and higher interest rates. The IRS rulings changed policies such that if certain requirements were met then claimants could have federal income tax waived.[4] Higher interest rates result in lower present values, hence annuity premiums, for deferred payments versus a lump sum.

Structured settlements have become part of the statutory tort law of several common law countries including Australia, Canada, England and the United States. Structured settlements may include income tax and spendthrift requirements as well as benefits and are considered to be an asset-backed security.[5] Often the periodic payment will be created through the purchase of one or more annuities, which guarantee the future payments. Structured settlement payments are sometimes called periodic payments and when incorporated into a trial judgment is called a “periodic payment judgment."

The United States has enacted structured settlement laws and regulations at both the federal and state levels. Federal structured settlement laws include sections of the (federal) Internal Revenue Code.[6] State structured settlement laws include structured settlement protection statutes and periodic payment of judgment statutes. Forty-seven of the states have structured settlement protection acts created using a model promulgated by the National Conference of Insurance Legislators ("NCOIL"). Of the 47 states, 37 are based in whole or in part on the NCOIL model act. Medicaid and Medicare laws and regulations affect structured settlements. To preserve a claimant’s Medicare and Medicaid benefits, structured settlement payments may be incorporated into “Medicare Set Aside Arrangements” “Special Needs Trusts."

Structured settlements have been endorsed by many of the nation's largest disability rights organizations, including the American Association of People with Disabilities [7] and the National Organization on Disability.[8]

Successful asbestos ligation requires an attorney who understands the many facets of the case, from how people get exposed to asbestos to the state-by-state regulations about filing lawsuits, to the fragile nature of many clients. Often, people who inquire about an asbestos-related claim are people who are also coping with mesothelioma cancer and all the health issues that go along with treatment.

The dangers and toxicity of asbestos were well-known in the 1930s, yet corporations continued using it extensively through much of the 20th century. SELL ANNUITY PAYMENT NEW 2015

SELL ANNUITY PAYMENT NEW 2015

Highlights
  • $6 billion worth of new structured settlements are written each year.
  • There were more than 35 million annuity contract in place at the end of 2007.
  • Before you can get cash out, you will have to prove a critical need for the money.

From multinational corporations to working class families on Main Street, it seems just about everyone is searching for cash and liquidity these days -- often in some rather unusual places.
Selling annuities, structured settlements, scheduled lottery payoffs or other ongoing payments for cash has become more popular in recent years, and now that a cash crunch has set in, more people are looking at their options. Unless the financial predicaments are dire, most financial advisers recommend against cashing in annuities or structured settlements. Selling off an annuity can trigger surrender charges as high as 10 percent, and those who sell before age 59½ can also face federal taxes and penalties. Structured settlements are attractive because they generally provide tax-free income for life.
Yet sometimes cashing in is the only option. That $500 monthly payment from an accident in 2002 may have helped with the medical bills early on, but if the beneficiary has now lost his job, watched his investment portfolio shrink by 40 percent in the past year and is on the verge of losing a home, a lump sum payout of $50,000 may seem quite enticing.

Americans have a great deal of money tied up in structured settlements and annuities, and more than $6 billion worth of new structured settlements are written each year, according to the National Structured Settlements Trade Association. At the end of 2007, there were also 35.1 million individual annuity contracts in place exceeding $2.02 trillion, according to LIMRA International, a nonprofit group that compiles life insurance data.

It's my money, and I want it now!

J.G. Wentworth is one of the world's largest buyers of structured-settlement payments and annuities and has handled more than $2 billion in payment transfers over the past 15 years. Chief marketing officer Ken Murray says that the company has seen a steady increase in customer inquiries in the past year. Despite what is happening in the economy, there are always people looking to sell annuities, structured settlements and lottery winnings, Murray says. Due to the nature of the business, buyers of payments usually see customers when they are in some sort of financial predicament."Historically, the common denominator is people who need cash, but there are some new reasons we are hearing more frequently than others as a result of the recession. It might be the fact that they lost their job or their mortgage payments have increased," says Murray.

Car Donation Tax Deduction - How to Get The Maximum Tax Benefit Out of Your Vehicle Donation

Donating your car or vehicle to charity can be a great way to get a tax deduction, and Wheels For Wishes makes it easy. If you would like to help your local Make-A-Wish® and get the maximum tax deduction, then you're already almost done. It's as simple as filling out the little form to the right or calling 1-877-431-9474. We make the process easy, and you get the most good (and highest tax deduction) for your car. Not only that, but you are also helping a local child's wish come true.

how car donation tax deduction works

Prior to January 2005, the IRS was allowing people who donated to a qualified car donation program to take a tax deduction based on their vehicle's market value no matter how much or how little the vehicle sold for. Determining the market value of a donated vehicle is often quite difficult and time-consuming, which made determination of the amount of the tax deduction confusing. Fortunately, as a result of the new tax law that went into effect in January 2005, the IRS has taken the guesswork out of determining the value of your donated car, truck, RV, boat or other vehicle.

The IRS allows the taxpayer to claim a charitable tax deduction as follows:

  • We make it easy to get the maximum tax deduction for your vehicle donation! Simply filling out the quick form to the right (or call 1-877-431-9474) and we take care of the rest. Your vehicle is picked up, sold, and proceeds benefit your local Make-A-Wish®, but you also get a 100% deductible receipt.
  • If the donated vehicle is sold for less than $500, you can claim the fair market value of your vehicle up to $500 or the amount it is sold for if less than fair market value.
  • If the donated vehicle sells for more than $500, you can claim the exact amount for which the vehicle is sold.
  • In either case, you will receive a 100% tax deductible receipt at the time that your vehicle is sold, stating the amount of the sale.
For any vehicle sold for more than $500, the exact amount it is sold for will be stated on your notification mailed to you, which in turn will be your charitable tax deduction. For additional information, the IRS provides A Donor's Guide to Car Donations (Publication 4303 linked below), which details the determination of the value of your donated vehicle. As always, we help people donate their cars every day, and we would be happy to help you do the same. Feel free to call us at 1-877-431-9474 with any questions you might have and one of our representatives will help you.

MESOTHELIOMA LAW FIRM New 2015

MESOTHELIOMA LAW FIRM New 2015

Mesothelioma (or, more precisely, malignant mesothelioma) is a rare form of cancer that develops from cells of the mesothelium, the protective lining that covers many of the internal organs of the body. Mesothelioma is most commonly caused by exposure to asbestos.[1] The most common anatomical site for mesothelioma is the pleura (the outer lining of the lungs and internal chest wall), but it can also arise in the peritoneum (the lining of the abdominal cavity), the pericardium (the sac that surrounds the heart),[2] or the tunica vaginalis (a sac that surrounds the testis).

Most people who develop mesothelioma have worked in jobs where they inhaled or ingested asbestos fibers, or were exposed to airborne asbestos dust and fibers in other ways. Washing clothes of a family member who worked with asbestos also creates a risk for developing mesothelioma.[3] Except lung cancer, there seems to be no association between mesothelioma and tobacco smoking, but smoking greatly increases the risk of other asbestos-induced cancers.[4]

Signs and symptoms of mesothelioma include shortness of breath due to pleural effusion (fluid between the lung and the chest wall), chest wall pain and constitutional signs such as unexplained weight loss. The diagnosis may be suspected based on chest X-ray and CT scan findings, but must be confirmed either by examining serous effusion cytology or with a biopsy (removing a sample of the suspicious tissue). A thoracoscopy (inserting a tube with a camera into the chest) can be used to acquire biopsy material, and allows the introduction of substances such as talc to obliterate the pleural space (a procedure called pleurodesis), preventing more fluid from accumulating and pressing on the lung. Despite treatment with chemotherapy, radiation therapy or sometimes surgery, mesothelioma carries a poor prognosis. Research about screening tests for the early detection of mesothelioma is ongoing.
